Terms Of Use

Please read these Terms of Use carefully, as they contain important information about your legal rights, remedies, and obligations. Specifically, these Terms of Use constitute a legally binding agreement between you (“the Client”) and Leadable (“the Company”, “we”, “our”), governing your access to and use of Leadable’s services (the “Services”). By using the Services, you accept these Terms in full. If you do not agree to these terms, you should not use the Services.
1. Company Information
1.1. Leadable is a trading name of LDBL Limited, a company incorporated in Ireland with registration number 697628 and a registered office address at 13 Adelaide Road, Dublin 2, D02 P950, Ireland.
2. Scope of Services
2.1. The Company provides outbound sales and marketing campaign services. This includes the design, production, and shipment of personalized items, as outlined below: The Client provides a target list of contacts and writes the copy which appears on the personalized direct mail items (“Uploaded Content”). We handle design, production, and shipment of these items to the specified contacts. The Client is responsible for all follow-up campaigns and related activities.
2.2. The Company will provide a digital version of all designs before production of the items begins, allowing the Client to request any changes before production begins.
2.3. As part of the Services, the Company may use publicly available content, data, or imagery (such as names, titles, company details, or profile photos from public websites like LinkedIn), including AI-generated derivatives thereof. This content is used solely to personalize creative assets on behalf of the Client. By engaging with the Services, the Client acknowledges and accepts this approach.
3. Costs, Payments and Term
3.1. Our services are subject to a monthly retainer fee or pilot fee (“Service Fee”) as agreed upon in writing between the parties (including via email or Service Agreement).
3.2. Our services are subject to a set timeframe (“the Service Period”). Unless otherwise agreed upon, the Service Period is three (3) months from the commencement of the agreement.
3.3. Services may renew if both parties agree before the end of each Service Period.
3.4. All payments are due in advance of Services being rendered. Failure to make timely payments may result in service delays.
3.5. Payments are processed securely via Stripe, Wise or wire transfer. By providing payment information, Clients authorize the Company to charge the provided payment method.
3.6. Fees exclude applicable taxes unless stated otherwise.
4. Confidentiality
4.1. Both parties agree to keep all non-public information shared during the course of the Services confidential and to use it only for the purpose of delivering or receiving the Services. This obligation does not apply to information that is publicly available, independently developed, or lawfully received from a third party.
5. Data Protection & Privacy
5.1. The Company collects and processes personal data in accordance with its Privacy Policy. Data is used to provide and improve Services, personalize mailers, and analyze performance.
5.2. Clients must ensure that they have the right to provide the Company with any personal data submitted. Clients are responsible for complying with all applicable data protection laws as Data Controllers.
5.3. The Company employs industry-standard security measures to protect personal data. Data is stored securely within the EU.
6. Intellectual Property Rights
6.1. All intellectual property rights in the Services are owned by the Company. Clients are granted a limited license to use the Services as per these Terms.
6.2. All intellectual property rights related to any content or assets provided to the Company, are owned by the Client, and the Company has a limited license to use the Client's intellectual property for performance of the Services.
7. Liability
7.1. To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or exemplary damages (including reputational harm or third-party claims relating to publicly available materials) arising out of or in connection with the Services.The Company’s total cumulative liability shall not exceed the amount paid by the Client for the Services. This limitation shall not apply in cases of gross negligence, willful misconduct, or claims subject to indemnity under these Terms.
8. Indemnity
8.1 Each party agrees to indemnify and hold harmless the other from any third-party claims arising directly from its gross negligence, willful misconduct, or material breach of these Terms. This does not apply to the use of publicly available or AI-generated content as outlined above.
9. Governing Law
9.1. These Terms Of Use are governed by the laws of Ireland.
9.2. Any disputes will be settled exclusively in the courts of Ireland.
9.3. Where a separate Service Agreement specifies arbitration, those provisions shall prevail.
10. Notices
10.1 All notices must be sent in writing via email and will be considered received immediately upon delivery or within 14 days if sent by post.
11. Changes to These Terms
11.1. The Company reserves the right to update these Terms Of Use at any time.
11.2. Any changes will be posted on our website and will apply to services provided thereafter. Clients will be notified of significant changes via email. If you disagree with the revised Terms Of Use, you may terminate this Agreement with immediate effect by contacting support@leadable.io
11.3. These Terms Of Use constitute the entire agreement between the Client and the Company regarding the Services. If the Client and the Company enter into a separate written agreement signed by both parties ("Service Agreement"), the terms of that Service Agreement shall take precedence over these Terms and Conditions to the extent of any conflict.
12. Additional Provisions
12.1. Force Majeure - the Company is not liable for delays or failures due to events beyond reasonable control.
12.2. Clients consent to receive communications electronically.
